Welcome to BizAI. These Terms and Conditions ("Terms") govern your access to and use of the BizAI Business Interaction and Communication Operating System. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Acceptance of Terms
By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and BizAI.
Description of Services
BizAI is a Business Interaction and Communication Operating System that orchestrates inbound and outbound interactions across voice, SMS, web chat, Facebook Messenger, Instagram DMs, appointment requests, internal notifications, and automated follow-ups. BizAI services include but are not limited to:
- AI-powered voice call handling and routing
- Omnichannel messaging (SMS, web chat, Facebook Messenger, Instagram DMs)
- Lead capture and qualification
- Appointment scheduling and calendar management
- Intelligent call routing and escalation
- Internal notifications and operational workflows
Service Availability and Limitations: While BizAI is designed for continuous operation, we do not guarantee uninterrupted service. Temporary service interruptions may occur due to maintenance, external factors, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.
User Responsibilities
As a user of BizAI services, you agree to:
- Provide accurate, current, and complete information during registration and use
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Use our services in compliance with all applicable laws and regulations
- Be responsible for all activities that occur under your account
- Configuration and Compliance: You are responsible for configuring BizAI appropriately for your business needs and ensuring compliance with applicable laws and regulations, including but not limited to call recording consent laws, data protection regulations, and industry-specific requirements
- Business Decisions: You are responsible for all business decisions made based on BizAI outputs and interactions
Acceptable Use Policy
You agree not to use our services to:
- Violate any laws, regulations, or third-party rights
- Transmit spam, unsolicited communications, or fraudulent content
- Interfere with or disrupt the integrity or performance of our services
- Attempt to gain unauthorized access to our systems or networks
- Use our services for any illegal, harmful, or abusive purposes
- Reverse engineer, decompile, or attempt to extract source code from our services
Subscriptions & Billing
By subscribing to BizAI, you authorize BizAI to charge the payment method on file on a recurring monthly basis at the agreed-upon rate.
Subscriptions automatically renew each billing cycle unless canceled prior to the next billing date. Charges are non-refundable once a billing cycle has begun.
BizAI provides AI-powered call handling and automation services. While uptime is designed to be continuous, BizAI does not guarantee uninterrupted service and shall not be liable for temporary outages beyond reasonable control.
You may cancel your subscription at any time by contacting support at support@bizai.technology. Cancellation takes effect at the end of the current billing cycle.
Fair Use Policy
BizAI plans include reasonable usage consistent with normal business call volumes. Excessive or abnormal usage may require a plan adjustment or additional fees, which will be communicated in advance.
Uptime Expectations
BizAI operates 24/7 using cloud-based infrastructure with standard industry uptime expectations. Temporary service interruptions may occur due to maintenance or external factors.
SMS Messaging Terms
If users opt in to receive SMS messages, they agree to receive automated and non-automated messages related to BizAI services. These messages may include appointment reminders, service updates, customer support communications, and account notifications.
Message frequency may vary. Message and data rates may apply.
Users may opt out at any time by replying STOP to any message. For more information, please see our SMS Messaging Consent page.
Messaging Terms
If you are experiencing issues with our messaging program, you can reply with the keyword HELP for more assistance, or contact us directly at support@bizai.technology.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and from you to us. Message frequency may vary depending on interactions and service usage.
If you have any questions about your text messaging plan or data plan, it is best to contact your wireless provider directly.

Intellectual Property
All content, features, and functionality of the BizAI Business Interaction and Communication Operating System, including but not limited to text, graphics, logos, software, and AI models, are the exclusive property of BizAI and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE OUR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES; OR (D) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH OUR SERVICES.
Termination of Service
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice, for any reason including but not limited to violation of these Terms. You may also terminate your account at any time by contacting us at support@bizai.technology. Upon termination, your right to use our services will immediately cease, and we may delete your account and data.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in California, and you consent to the exclusive jurisdiction of such courts.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
